The 2nd District Court of Appeals has just granted a temporary stay of Judge Katherine Forrest’s injunction against the NDAA. Since May, Judge Forrest had prevented the NDAA from being used anywhere in the world. Now, the NDAA is back in full effect, bringing with it the Law of War.

Military law, as authorized under the NDAA, grants you no Constitutional rights whatsoever.

There is no First Amendment rights in the Law of War There are no 2nd, 3rd, 4th, 5th or 6th Amendment rights in the Law of War. The Law of War is anathema to our Constitution, our Bill of Rights, and everything America stands for.

Thanks to the Appeals Court, we again have military law in America.

Obama Admin Appeals NDAA Ruling

In the dead of night, the NDAA was signed. Now, under the cover of events in the Middle East, the Obama Administration appeals a ruling striking the NDAA as Unconsitutional. It will now go to the 2nd District Court of Appeals.

The fight against indefinite detention is only beginning.

Judge Strikes down NDAA, but wait…

Judge Katherine Forrest released her ruling on the National Defense Authorization Act today, permanently striking down sections 1021 and 1022. These sections allow for the indefinite detention of American citizens without charge or trial. In her earlier ruling, Judge Katherine Forrest said this measure has a “chilling effect on first amendment rights.”

Based on her earlier temporary injunction, this ruling was expected. However, it is not time to celebrate. Based on the Obama Administration’s previous action an Appeal or a Motion for Reconsideration will likely be filed. The administration has also not said whether or not it is enforcing the NDAA, according to a letter from lawsuit organizer Tangerine Bolen. The case will then go to an appeals court.

The Obama administration will have approximately 60 days to file either a Motion for Reconsideration or an Appeal. We have posted the “Countdown to Appeal” timer on our website.

If that counter reaches zero, party like there’s no tomorrow.

Until then, stay vigilant. If we party too soon, we will lose the fight.
