ACTION ALERT: Texas Anti-NDAA Bill Heads to House Floor

You don’t mess with Texas. At least, that’s precisely what State Rep. Lyle Larson is saying with HB 149.

HB 149 is designed to counter the indefinite detention provisions, sections 1021 and 1022, of the 2012 National Defense Authorization Act. These sections authorize the indefinite military detention, without charge or trial, of anyone who commits a “belligerent act,” or is suspected of terrorism, and violate over 13 provisions of the U.S. Constitution and Bill of Rights. the law has also been condemned by retired members of the Armed Forces, a current U.S. CongressmanFederal Judge Katherine B. Forrest, conservative pundit Rush Limbaugh, and the American Civil Liberties Union.

Rep. Larson’s bill, once amended, will protect the people of Texas from indefinite military detention and extrajudicial assassination without charge or trial. However, we have to get it through Committee first.

It’s time to bring the pressure. One call, and taking 30 seconds to tell your legislator what you think, can make all the difference.

Contact members of the Texas House Federalism and Fiscal Responsibility NOW and tell them, politely but firmly, you will accept nothing less than a YES on HB 149. (Out-of-staters are encouraged to call as well.)

PANDA Endorses H.R. 198

On September 14, 2001, in the wake of one of America’s greatest national tragedies, Congress gave the President unilateral power to use “all necessary and appropriate force” against those nations, organizations, or persons who planned, committed, or aided the terrorist attacks of 9-11.

On October 14th, 2011, a 16-year old American citizen from Colorado, Abdulrahman al-Awlaki, was blown to pieces by a hellfire missile. He had no connection to the terrorist attacks of 9-11.

The assassination of a 16-year old is just one of numerous examples of the overbroad interpretation of the 2001 Authorization for Use of Military Force. In response, a bipartisan group of U.S. Representatives led by Barbara Lee (D-CA) have introduced H.R. 198 to repeal the 2001 Authorization for Use of Military Force.

H.R. 198 reads as follows:

“Be it enacted by the Senate and House of Representatives of the

United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the “Repeal of the Authorization for Use

of Military Force”.

SEC. 2. CONGRESSIONAL FINDING.

    Congress finds that the Authorization for Use of Military Force

(Public Law 107-40; 50 U.S.C. 1541 note), signed into law on September

18, 2001, has been used to justify a broad and open-ended authorization

for the use of military force and such an interpretation is

inconsistent with the authority of Congress to declare war and make all

laws for executing powers vested by the Constitution in the Government

of the United States.

SEC. 3. REPEAL OF PUBLIC LAW 107-40.

    Effective 180 days after the date of the enactment of this Act, the

Authorization for Use of Military Force (Public Law 107-40; 50 U.S.C.

1541 note) is hereby repealed.”

Legislation like this is sorely needed to reign in the “war on terror” powers our Congress gave the President. The Authorization for Use of Military Force has given rise to the 2012 National Defense Authorization Act (NDAA), extrajudicial execution of U.S. citizens, and the expansion of Presidential war powers to a level never authorized in the Constitution.

PANDA wholeheartedly endorses H.R. 198 as introduced. We must restore Constitutional governance in the United States, and this bill will be a giant step in the right direction.

On Fire for Liberty: Las Vegas Passes Anti-NDAA Resolution

PANDA Nevada (People Against the National Defense Authorization Act) announces the passage of a Las Vegas City Council Resolution defeating the indefinite detention provisions of the 2012 NDAA (National Defense Authorization Act). 

Just before noon on Wednesday, the honorable Las Vegas City Council passed a resolution rebuking the indefinite detention provisions of the 2012 NDAA, 5-2. The resolution may be read here at: http://tinyurl.com/cyu5bue.  The Resolution will now head to the Clark County Commission; if passed, it would be the first Joint City/County Resolution passed in response to the NDAA.

The 2012 National Defense Authorization Act was overwhelmingly passed by Congress and signed into law by President Barack Obama on December 31, 2011. The 2012 NDAA declares the United States to be a battlefield in the war on terror and Section 1021 & 1022 authorize the indefinite military detention, without charge or trial, of persons on US soil.

This violates at least 23 Articles of and Amendments to both the US and Nevada Constitutions.

PANDA’s Clark County Chapter Head, Daphne Lee, stated,

“I am so incredibly grateful to the honorable Council members for supporting our efforts. I would especially like to thank Councilman Beers for helping me introduce this resolution to the board, and to Mayor Goodman for her amazing vocal support for the rights of all persons in Nevada. This action will support other cities, counties and states all over the country who seek to take a stand to protect constitutional rights.”

Christopher Corbett, PANDA Nevada State Team Leader, said, “This is an important first victory in the fight to restore and protect civil liberties in Nevada. Hopefully this resolution will encourage the rest of Nevada to pass similar resolutions and state legislation.”

There is already action under way to pass similar Resolutions in Northern Nevada.  Both the Washoe County Commission and Reno City Council have agrees to look at this issue in the next 30 days.

State Senator, Don Gustavson, has also submitted a bill to be considered during the 2013 Nevada legislative session.  The Nevada Liberty Preservation Act (SB378), which has 16 bi-partisan cosponsors, will lead the way in restoring Constitutional rights to all persons in Nevada.
This movement is just getting started. “We the People” will take back this great nation, one city, County, and State at a time.

Trudeau’s New Slogan “Just Watch Me” [videos included]

Back in October of 2012, we had a chance to ask Justin Trudeau some real questions. One of them was would he would correct his fathers wrongs (in relation to the Bank of Canada)? In response he stated that he was not there to defend his fathers legacy.

But now it seems that he has no problem using his fathers legacy, when it suits him best (big surprise there).

On a near-empty Porter Airlines flight from Halifax to Ottawa Tuesday evening, Trudeau was sent a note from a fellow passenger asking: “Can you really beat Harper?”

“Just watch me,” Trudeau wrote back, invoking Pierre Trudeau’s famous phrase during the 1970 October Crisis.

The “just watch me” quote became famous during the October Crisis of 1970. When the Front de libération du Québec (FLQ) kidnapped British Trade Consul James Cross. Then five days later, Quebec Labour Minister Pierre Laporte was also kidnapped and murdered. Trudeau responded by invoking the War Measures Act (the same measure that was used for the Toronto G20 summit), which gave the government sweeping powers of arrest and detention without trial. Trudeau also brought in the military for policing actions.

CBC’s Tim Ralfe, grilled Trudeau on his creation of a full out police state on October 13 1970.

Ralfe asked, how far he would go to maintain law and order amid the Front de libération du Québec (FLQ) kidnappings.

“How far would you go with that? How far would you extend that?” Pierre responded “just watch me”.

It really is incredible that a man who is trying to become our next prime minister is able to use his fathers quotes, from a period that saw a province turned into a complete totalitarian police state. And John Q public along with the main stream media is just eating it up. This truly is a sign of our times!

Las Vegas to Introduce Anti-NDAA Resolution

The fight against indefinite military detention continues. Yesterday, the Las Vegas City Council and the Clark County Commission drafted anti-NDAA legislation to protect the Constitutional rights of their constituents.

City Councilman Bob Beers and County Commissioner Chris Giunchliani put forth the draft.

Afterward, Daphne Lee, the Clark County Chapter Head of PANDA, and Christopher Corbett, Nevada Executive Director of PANDA, expressed their gratitude to Beers and Giunchliani. Corbett said:

“This initiative will help raise awareness of the NDAA and encourage other municipalities and our state legislators to do the same.”

Specifically, sub-sections 1021 and 1022 of the NDAA allow the indefinite arrest, imprisonment and/or transport to foreign prisons of anyone on U.S. soil whom the federal government declares is a terrorist suspect. In short, the2012 NDAA enables the government to make any person on U.S. soil a prisoner of war.

Currently making its way to committee in the Nevada State Legislature is a related bill, Don Gustavson’s BDR 728, the Nevada Liberty Preservation Act.

Tax Bicyclists For Exhaling CO2 When They Ride, Says Wash. Rep

Taxing the air we breathe may be coming to Washington state.  Yes, the insane taxing of every behavior is rising to a whole new level with the proposed “bike tax” in Washington.

According to lawmakers who proposed the bike tax, it would help raise $1 million over the next decade to be used for road maintenance. The new $25 tax will be applied on every bike sold for over $500 in the state.

One Washington lawmaker is making twisted argument in support of the new fee. Rep. Ed Orcutt wrote in an email to a bike shop that the CO2 that bicyclists exhale while riding is just one of the reasons he supports the bike tax.

“Since CO2 is deemed a greenhouse gas and a pollutant, bicyclists are actually polluting when they ride,” Orcutt wrote. Therefore, they should pay taxes to help the environment as well as the roads.
