Ontario’s highest court has signalled that the right of police officers to look through someone’s phone depends on whether there’s a password.
The Court of Appeal for Ontario says it’s all right for police to have a cursory look through the phone upon arrest if it’s not password protected, but if it is, investigators should get a search warrant.
The court’s ruling comes in the case of a man who appealed his robbery conviction, arguing that police breached his charter rights by looking through his phone after his arrest.
Kevin Fearon was arrested in July 2009, after a jewelry stall at a flea market in Toronto was robbed, and police found pictures of a gun and cash as well as a text message about jewelry on his phone.
The Appeal Court denied his appeal, saying that police were allowed to look through Fearon’s phone “in a cursory fashion” to see if there was evidence relevant to the crime, but after that they should have stopped to get a search warrant.
The court says if the phone had been password protected or otherwise locked to anyone other than its owner, “it would not have been appropriate” to look through the phone without a search warrant.
The Appeal Court judges referenced a decision in a murder case in which the judge did not allow evidence from a personal electronic device because it “functioned as a mini-computer,” which has a high expectation of privacy. The contents of that device were only extracted by a police officer using specialized equipment in that case, the Appeal Court judges noted.
“There was no suggestion in this case that this particular cell phone functioned as a ‘mini-computer’ nor that its contents were not ‘immediately visible to the eye,’ the court said in its ruling, released Wednesday.
“Rather, because the phone was not password protected, the photos and the text message were readily available to other users.”
The court, though, declined to create a specific new rule for all cellphone searches.
“It may be that some future case will produce a factual matrix that will lead the court to carve out a cellphone exception to the law,” the ruling said. “To put it in the modern vernacular: ‘If it ain’t broke, don’t fix it.”‘
It was only a few months ago that Hamlton’s Mayor Bob Bratina stated “If ICLEI Is A Conspiracy To Take Over The World I would Like To Join Today”, At the 2012 ICLEI livable cities forum.
It seemed as if he was just trying to make a joke, especially since the city of Hamilton has been “in on” the conspiracy of ICLEI/Agenda 21 since the year 2000 (when they joined ICLEI).
His plans to usher in the next phase of the Agenda 21 framework are now showing through and are no laughing matter.

Home builders in Hamilton and Halton are being told to look up, not out, for future developments.
Mayors Bob Bratina and Rick Goldring, of Hamilton and Burlington respectively, told local home builders Friday the days of sprawling subdivisions as the major form of growth in the cities are over, replaced by a changing market demanding projects closer to amenities. The city leaders’ breakfast is a traditional opening to the Home Show.
For Bratina, it’s a simple matter of space — Hamilton can’t spread out any more.
“My answer to that is to think vertical,” he said in an interview after his presentation. “If you’re running out of land, then the only way to go is up.”
Convincing home buyers of that isn’t a major issue, he added. Empty-nesters and young professionals are voting with their wallets for smaller properties and better condos where they’re close enough to walk to what they need. The ones who have to be convinced are home builders.
“A lot of traditional home builders grew their business in the era of the ’50s and ’60s when there was a different set of circumstances,” Bratina said. “Well, everything has changed and I think the era of scraping all the topsoil off a farm and putting up a cookie cutter subdivision is coming to an end.” Continue Reading
The debate surrounding the Ontario Welfare system, and more specifically what the recipients are doing with the money they receive. Has been highly publicized over the years. With many politicians offering tinker box solutions, that do not seem to solve any problems there might be.
One of the main concerns of tax payers and politicians alike has been that Ontario works recipients are spending the monies on alcohol, cigarettes, drugs, etc. Instead of essential needs. Who wants to be paying for other peoples vices right?
Tim Hudak and the Ontario PC’s announced a plan to overhaul the welfare system on Thursday morning.

Highlights of the 12 “paths to prosperity” outlined in the 22-page Tory “white paper” introduced Thursday include:
rolling Ontario Works and the Ontario Disability Support Program into one agency with streamlined rules
submitting all social programs to “value-for-money” audits
opening up social program delivery to non-profit agencies, charities or the private sector
a requirement for individualized employment plans that detail the monthly activities required to qualify for income support
steadily declining benefits, to discourage long-term reliance on welfare cheques

The last highlight of their “paths to prosperity” is to issue a “smart” debit card to recipients. Makes sense right? Blocking the ability for them to purchase any of the unwanted items.
But sadly like most idea’s that seem to make sense. It is only a first stage. Using a government issued “smart” card would mean that government agents (employees) will be able to track and access all records for everything that these people buy. There are many books and documentary’s out there, that spell out how this type of control can go wrong.
Envision a future where every purchase you make is stored in a database. Later in life you develop a disease, for this I will use the example of diabetes. Doctors will be able to look into your history and conclude that you treatment should cost X amount of dollars more, because you purchased chocolate ice cream on a regular basis.
And as most totalitarian laws/regulations. The low income, impoverished people will be affected first.
This type of totalitarianism in not needed. The human race is a innovative beautiful thing! We can adapt, problem solve, and figure out some of the most difficult questions in life. It is time to use that, in fixing these everyday problems rather than turning to big daddy government to do it for us!
The video of Eliza Lam in what are her final known moments (police aren’t sure yet what transpired between the CCTV capture of her attempt to get an elevator to work and the discovery of her corpse in a hotel water tank weeks later) has captivated and creeped out much of the internet, given Lam’s strange and visibly “off” behavior in her last sighting.
The Elisa Lam video surfaced after the Canadian student’s death was discovered, but what we don’t know is what happened between that moment and her death. It’s possible Lam survived longer, and what occurs on camera is perhaps a source of further confusion rather than an elucidation.
On my way home yesterday, I ran into a friend who told me that the medical marijuana dispensary down the street had just been raided. I rushed over to see what I could find. The police had already left the scene and the store was closed.
“Police in Ontario executed raids today on both the MCCM medical marijuana dispensary in Hamilton and the Brantford home of the business’s operator Pete Melanhead.
The bust of a distribution shop in Hamilton and a grow-op bust in Brantford has put a dent in the local marijuana trade.
Hamilton police swooped down on a marijuana distribution shop at 174 King Street West. The shop used to be La Riviera Shoes but had only a few pieces of clothes in the window. No word yet on charges.
And Brantford police have arrested and charged three people, after finding a marijuana grow-up with over 55 plants inside a Brantford apartment complex. Police say they searched the property on Winniett Street Tuesday night and found $55,000 worth of marijuana plants and more than $400 worth of dried marijuana.
Though the CHCH story does not actually link the two events or indicate a connection between the two busts, a trusted source informed Cannabis Culture the Brantford home is the residence of Melanhead, operator of the MCCM. Since Stephen Harper and the Conservatives gained their majority government in the last election. It has seemed as if they have been so focused on the economy that the environment has taken a back seat to it. Leaving the Kyoto protocol, oil pipelines, Chinese investments into the oil sands in Alberta, labeling environmental groups as potential terrorist threats, and most recently the removal of protection on thousands of lakes and rivers across the nation, in Bill C-45.
In response to all of these actions many groups and activists have become more active. But more importantly have begun to learn how to network with each other and work together. Which in an ideal situation would be great. But sadly we do not find ourselves in an ideal situation at this point of time.
Environmental groups (including the most radical factions), socialists, communists, anarchists, Occupy groups, and most recently indigenous people’s are all beginning to band together to protect mother Earth and the environment. Creating a collective network (mind you in is in it’s early stages). A collective network to fight back at the loosening of regulations and the corporate greed that has driven those changes.
But how loose has our government gotten when it comes to the environment?
Yes, as stated above our government has begun to develop the tar sands, it has left the Kyoto protocol, etc. But when it comes to sustainable development we rank near the highest in the world.
The Federal Sustainable Development Strategy progress report section 2.4 openly states that the federal government is “Implementing a New Approach”.
The new approach calls for government to take the first steps in curbing our “carbon footprint”. By shrinking government. Which would mean consolidating services and shrinking the payroll (hence less federal protections). The governments approach also calls for establishing a sustainable development office. Which would over see a large portion of environmental issues.

This shift in policy has also been enacted at the provincial and municipal levels. All provinces and cities/towns have sustainable action plans that stem from the Federal plan.
British Columbia was the first province or state in North America to implement a carbon tax, while both Ontario and Quebec have passed legislation for cap and trade schemes. Quebec has announced their cap and trade plan already but Ontario has not unveiled theirs yet.
Quebec also announced their new historic conservation plan this year. Plan Nord, a sustainable development initiative for the 425,000-square-mile northern boreal region. This undertaking includes a commitment to put half of the area off limits to industrial activity.
Nearly all cities/towns also have their sustainable plans well established. All one has to do is go to their city website and search sustainable development. Here in Hamilton the plan is called “vision 20/20″.
To put it simply our government is undergoing a massive environmental shift. A shift that will allow corporations to develop heavily polluting industries, in certain area’s. While passing the bulk of responsibility of environmental protection on to the average person through sustainable development and taxation.
Maybe that is why the government (at any level) has not been quick to dispel the claims of a “lack of environmental responsibility”. Or maybe they see this as an opportunity?

By playing the pawn Stephen Harper off as the “bad guy” (don’t get me wrong I cannot stand the guy personally) we will see a continuation of collectivist groups merging and becoming stronger. With the help of main stream media, government, NGO’s, and average people who have been duped. This collective is going to grow very quickly. Highlighting every environmental misdeed the government makes, and blaming climate change on nearly everything. While ignoring the shift to a “new plan”. Until the next election.
We are going to see the Liberals, NDP, and Greens all play on this very hard. Who doesn’t want clean air, water, and land? Who doesn’t want a better future for our following generations? After Stephen Harper’s destruction we cannot hesitate any longer! I can envision the speeches already. Gaining more support for the next Prime Minster (my bet is on Justin Trudeau) who, after being elected. Will promote the “new plan/shift” as theirs, (regardless of how old the plan is) and the majority of the populace while jump on board no questions asked! Who cares where the plan came from, or who developed it! We must act now!
We must all ask ourselves. Does this current government just lack environmental compassion and thought? Or is our perception merely being managed through a social engineering program to accept a “new” direction? A “new” plan?
